Terms of service
Preamble
These Terms and Conditions are agreed between the owner of the Online Store, Marta Alexandra N. de Almeida, with registered office at Rua Dr. Carlos Sacadura, Lote 1 Loja 3, 3200-202 Lousã, under tax identification number 230880193 (hereinafter referred to as Martha Almeida Jewellery), and any natural person of legal age and final consumer (hereinafter referred to as the User) who wishes to make a purchase and/or order of items and services sold by Martha Almeida Jewellery through the website www.marthaalmeida.com (hereinafter referred to as the "website").
The parties agree that their relationship will be governed exclusively by the terms and conditions of purchase, sale and ordering described here, which are permanently accessible to all Users on the website.
By visiting the website, registering, and purchasing or ordering any items and/or services from Martha Almeida Jewellery, the User declares that they have read, understood and fully acknowledged the provisions set out here, and accepts them in their entirety.
If the User needs any clarification, they can request it through the Website in the Contacts area or by sending an email to: info@marthaalmeida.com.
1. Purpose
The purpose of these conditions is to define the general conditions of sale established between Martha Almeida Jewellery and the User, from the moment of ordering through to the various services provided by Martha Almeida Jewellery, such as payment methods and delivery conditions.
These conditions govern all the steps necessary to place an order and ensure the follow-through of this transaction between the contracting parties.
2. Orders
To place an order, the User must register on the Website and provide certain personal data for that purpose, such as their name, address, etc. To do so, the User must fill in all the mandatory fields of the registration form.
(If you are already a registered User, you must identify yourself by entering your email address and your password.)
Once registration is complete, the User can proceed with the purchase by adding the desired items to the virtual shopping cart ("Your Cart"). In the virtual shopping cart, the User can always change the quantity of, or remove, the desired items.
To complete the purchase, the User must select the "Confirm Order" button and enter the requested details regarding the order, invoicing, shipping and payment.
Entering incorrect or incomplete data prevents the order from being processed, and Martha Almeida Jewellery accepts no liability for any loss resulting from such actions.
Details the User should bear in mind for correct conduct:
- Check the items added and their respective quantities;
- Select the delivery address, if the User chooses home delivery (billing address), or choose to ship to an address different from the billing address, or choose to collect the order at the Atelier Shop if they wish to pick it up;
- Confirm the total order amount and select the payment method;
- Before completing the purchase, confirm the overall order amount, including shipping costs;
- After confirming the details and the overall order amount, to complete the purchase the User must accept the Terms and Conditions.
The User can follow the purchases made through the "Customer Area".
Validation of the order means that the User has taken note of and expressly accepts these terms and conditions, available at www.marthaalmeida.com, as well as the prices and the description of the products offered for sale.
2.1. Order Confirmation
After making a purchase, the Customer will receive an automatic email confirming the transaction, which should be printed or saved for future reference, thereby formalising the contract of sale and purchase of the items bought.
The confirmation email will state the order number, which the Customer must use in any communication with Martha Almeida Jewellery. The order number is required to report any changes or errors in the order.
If the details are not correct, you may immediately request a change, or even the cancellation of the order placed, by sending an email to info@marthaalmeida.com. Any charges arising from errors not reported in good time will be borne exclusively by the User.
Your order will only be processed after payment has been confirmed. In the event of non-payment, non-compliance, or failure to confirm the Terms and Conditions on this page, Martha Almeida Jewellery reserves the right not to accept the User's order, or to cancel it, even after its automatic confirmation.
2.2. Unavailability of Items
If one or more items ordered by the User are unavailable, Martha Almeida Jewellery undertakes to inform the User and to refund any amounts paid within a maximum of 30 (thirty) days from the date it becomes aware of that unavailability.
2.3. Order Cancellation
Martha Almeida Jewellery reserves the right not to confirm and/or deliver the products of the order placed by the User, regardless of the reason and free of liability for any damages or costs, if:
- any unforeseeable event or change in current circumstances occurs that may affect production, transport and the associated costs, or that causes abnormal increases in raw material prices;
- for any reason, it is impossible to collect or receive the respective payment;
- the products ordered are no longer available;
- the order was placed with errors in the data essential for delivery;
- the order is flagged by the website's security systems as an incorrect, irregular and/or fraudulent order.
In any of the cases mentioned, Martha Almeida Jewellery undertakes to inform the User, by email, of the impossibility of confirming the sale and of the resulting cancellation of the order, refunding any amounts the User may have paid within a maximum of 30 (thirty) days from the date it becomes aware of that unavailability.
If the User needs to cancel their order after making a purchase, they should contact Martha Almeida Jewellery as soon as possible, through the contact form or by email at info@marthaalmeida.com.
If payment has been made and the order has not yet been shipped, the respective costs will be refunded in full, including the shipping cost. If the order has already been shipped, Martha Almeida Jewellery cannot accept the User's request to cancel the order (see the return conditions below).
Order cancellation does not include personalised items. In this case, a refund is not possible.

Martha Almeida Jewellery reserves the right to change shipping costs, provided that any such changes are communicated to the User in these terms and conditions of sale.
Martha Almeida Jewellery normally guarantees to dispatch processed (paid) orders by 1 pm on the same working day or, where this is not possible, within a maximum of 48 hours, except for personalised items or items with a production notice.
The order will be sent to the address given at checkout but, if the User wishes it to be sent to a different address, they must indicate this on the "Checkout" page and fill in the mandatory details for that purpose.
It is the User's responsibility to ensure that they, in person, are present at the address to receive the order, and the carrier is not required to give any prior notice. For all purposes, anyone present at the delivery address indicated by the User is presumed to be authorised to receive the order.
Martha Almeida Jewellery is not responsible for any damages or associated costs if the order is not delivered for reasons attributable to the User, such as an incorrectly entered shipping address, the impossibility of delivering to the address given due to the absence of the recipient or another person, or failure to collect the order from the shop or collection point.
Shipping costs are the responsibility of the User. Martha Almeida Jewellery will always have the right and the option to waive shipping costs for the User.
Martha Almeida Jewellery does not accept deliveries to PO boxes.

4. Payment
The sale underlying each order placed by the User is made subject to retention of title, so the items remain the property of Martha Almeida Jewellery until the amount due has been effectively and fully paid.
Martha Almeida Jewellery offers the User several payment methods:
– Credit card (Visa, Mastercard, American Express) – A payment method available for orders placed on the website. The order and card details will be sent, encrypted via an SSL certificate, to the banking entity on the date of your order. The purchase is considered complete when the corresponding credit is verified. If the transaction is rejected by the bank, the purchase will be automatically cancelled.
– PayPal – One of the most widely used payment methods for online purchases worldwide; a PayPal account is required to pay. For more information or to create an account, see this page: https://www.paypal.com/pt. If you choose this payment method, the order amount will be debited at the end of the ordering process.
– MB Way – With MB Way you can pay for your order quickly and conveniently through your smartphone, simply by having an MB Way account. MB Way orders will only be processed after payment is confirmed. For more information or to find out how to create an account, see this page: https://www.mbway.pt. If payment is not made within the stipulated period, or if, for some technical reason, the amount is reversed in your MB Way account, the order will be considered cancelled. Where payment has been made and Martha Almeida Jewellery needs to issue a refund (cancellations at the customer's request, out of stock, etc.), it will be made using this same payment method.
– Multibanco Reference – If you choose this payment method, you will receive an email with the details to pay at a Multibanco ATM or through online banking. After receiving the details, you have 12 hours to make the payment. If you do not pay within this period, the order will be automatically cancelled and any amount paid after the deadline will be refunded. Where payment has been made and Martha Almeida Jewellery needs to issue a refund (cancellations at the customer's request, out of stock, etc.), it will be made by bank transfer.
– Apple Pay – Allows payments to be made quickly and securely using compatible Apple devices, without the need to manually enter card details for each purchase. Payment is made upon completion of the order, subject to User authentication and transaction confirmation.
– Google Pay – Allows payments to be made quickly and securely using devices compatible with Google Pay and the cards linked to the service. Payment is made upon completion of the order, subject to User authentication and transaction confirmation.
– Shop Pay (Shop) – Allows payments to be made quickly and conveniently using payment and shipping details saved through the Shop Pay service, where available. Payment is processed upon completion of the order, subject to transaction confirmation.
– Klarna – Allows payments to be made using the payment options offered by Klarna at the time of purchase, which may include immediate payment or payment in instalments, subject to Klarna’s terms and approval. By selecting this payment method, the User agrees to the terms and conditions applicable to the service, available at https://www.klarna.com/pt/.
Martha Almeida Jewellery does not accept any other payment method for orders placed on the website.
To prevent fraud in transactions and payments made through the Website, Martha Almeida Jewellery uses preventive mechanisms that analyse purchase characteristics that appear to be fraudulent. To ensure that a transaction is not fraudulent, Martha Almeida Jewellery may ask the User for additional information or supplementary data.
If the User refuses to provide such additional information, Martha Almeida Jewellery reserves the right not to process the purchase or accept the order.
The User acknowledges that, even though Martha Almeida Jewellery uses advanced technological mechanisms and systems, system errors may occur. If this happens, the User can contact Martha Almeida Jewellery by email at info@marthaalmeida.com.
After the User has completed the purchase, the invoice to be issued will reflect the information provided by the User, the itemised prices of the items purchased, the shipping costs and the applicable VAT, and in no case will it be possible to change the details on it.
5. Items and Prices
The items displayed and sold on the Martha Almeida Jewellery website are catalogued in their respective product categories and collections. On each product page it is possible to see the description and technical details of the product, as well as the personalisation options available.
It is important that the User bears in mind that, due to the characteristics of handmade production, items may differ slightly from the images shown on the website.
Martha Almeida Jewellery undertakes to ensure that the items sold on the website are available in stock or to order, allowing the User to obtain this information on each product page. In the event of an unexpected stock shortage and where an immediate purchase or shipment is not possible, the User will be informed promptly.
The prices of the items shown on the website are in euros, including taxes (VAT) at the rate in force in Portugal. The prices shown take into account the VAT applicable on the day of the order. Any change in the applicable VAT will be reflected in the prices of the items. Prices do not include the shipping costs of the order (as per Article 3).
Martha Almeida Jewellery reserves the right, at any time, to change the price and specifications of items or services on the website, or to run promotional campaigns. There may also be variations in relation to prices found at events or in the Atelier Shop.
6. Exchanges and Returns
6.1. Right of Withdrawal
The User may exercise their right to withdraw from the contract under Decree-Law No. 24/2014 of 14 February.
To exercise their right of withdrawal, the User must inform Martha Almeida Jewellery of their decision to withdraw from this contract by means of an unequivocal statement sent by post or by email to info@marthaalmeida.com.
To exercise the right of withdrawal, it is sufficient that the communication regarding the exercise of that right is sent to Martha Almeida Jewellery within 14 calendar days from the day the User receives the items.
Items produced according to the specifications requested by the User, as provided for in Article 17 of Decree-Law No. 24/2014 of 14 February, are considered personalised products and are therefore excluded from the right of withdrawal. In these cases, the User cannot exercise the right of withdrawal, cannot return these items and will not be refunded.
In the event of withdrawal from this contract, the User must return the items in perfect condition, in their original packaging, accompanied by the original invoice, warranty certificates, gifts and any other documents that came with them, within a maximum of 14 (fourteen) days from the day on which they informed Martha Almeida Jewellery of the withdrawal from the contract.
The items must be sent/returned to the registered office address of Martha Almeida Jewellery given at the beginning of these terms and conditions. The address is also available for permanent consultation at https://marthaalmeida.com/loja/.
Return costs are the sole responsibility of the User, who must send the items with parcel tracking and must always keep proof of postage.
Once all the conditions above have been met, Martha Almeida Jewellery will refund the User the payment made, excluding delivery costs, within a maximum of 14 days after the return. The refund will be made using the same method used for the payment, except for payments made by Multibanco, for which the refund will be made by bank transfer.
6.2. Returning Items
The User has 14 days from the date the order is delivered (whether within Portugal or to other countries) to return the items purchased. To do so, the User must notify us of their intention to return, stating the order number, the item reference and the reason for the return, sending this information as soon as possible by email to info@marthaalmeida.com. The item must be returned in its original packaging, in perfect condition, with no signs of having been used or damaged, together with the purchase invoice, warranty certificate, gifts and all the items that came with the order.
The cost of return shipping is the responsibility of the User, who must send the items with parcel tracking and must always keep proof of postage.
Provided the return conditions are met, Martha Almeida Jewellery guarantees a refund within 14 days (shipping costs excluded) using the same payment method, except for payments made by Multibanco, for which the refund will be made by bank transfer. The User must provide the bank details to Martha Almeida Jewellery, preferably by email.
The return must be accompanied by a copy of the email previously sent to Martha Almeida Jewellery, with the item(s) and their accompanying items packed in a sealed package suitable for transport.
6.3. Exchanges
Within 14 days from the date the order is delivered, whether by pick-up or home delivery, an exchange is possible provided the item arrives at the premises of the registered office of Martha Almeida Jewellery in its original packaging and in the condition in which it was purchased, with the purchase invoice, warranty certificates, gifts and all the documents that came with the order. To do so, the User must notify us of their intention to exchange, stating the order number, the reference of the item purchased and of the item they wish to exchange it for, and the reason for the exchange, sending this information as soon as possible by email to info@marthaalmeida.com.
The User may exchange for another piece of equal or higher value.
The exchange can be made in person at the Atelier Shop during opening hours or through a carrier.
If the exchange is made through a carrier, the shipping costs of the exchange will not be refunded and the cost of the new shipment is the responsibility of the User.
All pieces are described with the utmost accuracy and properly packaged. However, if the User is not satisfied or finds any problem on receiving it, they should contact Martha Almeida Jewellery immediately, which will make every effort to resolve the matter.
Before placing your order, you should ask any questions you wish to have clarified.
7. Warranty
The warranty conditions are governed by Decree-Law No. 84/2021 of 18 October, which regulates consumer rights in the purchase of goods, under Directives (EU) 2019/771 and (EU) 2019/770 of 20 May.
The items sold by Martha Almeida Jewellery are covered by a manufacturer's warranty of 3 years. In the first two years, the defect is presumed to have existed when the item was delivered, so the consumer does not have to prove it in order to invoke the warranty; in the third year, the consumer must prove that the defect existed when the item was delivered.
The "right of rejection" allows the consumer to choose freely between replacement of the item and termination of the contract when the non-conformity appears within the first 30 days from delivery.
During the warranty period, an item with a manufacturing defect will be repaired free of charge or, where repair is not possible, replaced with a similar model. If the item is repaired (up to a maximum of 4 repairs), the warranty period is extended by a further six months.
The User must present the non-conforming item together with the original purchase invoice and the respective warranty certificate (stating the purchase date, name and reference assigned to the item, where applicable, or the product designation) or other suitable proof of purchase.
The cost of sending the item under warranty from the consumer to the Martha Almeida Jewellery atelier, where a manufacturing defect is proven during the warranty period, is the responsibility of Martha Almeida Jewellery. The consumer is reimbursed for this cost, by bank transfer or another payment method to be agreed with the User, within a maximum of thirty days from confirmation of the manufacturing defect.
Martha Almeida Jewellery will send the repaired item or the new item to the address indicated by the User at no additional cost.
The following are excluded from the warranty: items subject to breakage, loss, theft, deterioration, oxidation, loss of finish colour, defects caused by blows, including deformations resulting from daily use, improper use, inadequate maintenance and cleaning, negligence, improper handling, modifications to the original product and repairs not authorised by the brand.
The User can read here about the care they should take for the proper maintenance of Martha Almeida Jewellery jewellery.
8. After-Sales Service
During the warranty period, any damage or deformation not covered by the warranty, including loss of finish colour, inadequate maintenance and cleaning, negligence or improper handling, can be repaired by Martha Almeida Jewellery. In these cases, the brand provides technical assistance in its own workshop, upon presentation of a prior quotation.
Once the warranty period has ended, Martha Almeida Jewellery may provide technical assistance for items produced by the brand and bought by the User, who must request a quotation for the assistance service required, using the email address given above.
Any repair not covered by the warranty entails costs for the User, and Martha Almeida Jewellery will therefore only carry out the repair after the User has approved a quotation, and the quotation request must be sent to the email address info@marthaalmeida.com.
The cost of sending the item to the Martha Almeida Jewellery atelier is the responsibility of the User.
9. Acceptance and Proof
Validation of the purchase order means that the User has taken note of and expressly accepts these Terms and Conditions, available for consultation on the website. The computerised records, kept securely in the computer systems of Martha Almeida Jewellery, are considered proof of the communications, orders and payments made between the parties, in accordance with the legal provisions, and will allow the amounts shown in the order confirmation email to be enforced. This validation is equivalent to signature and acceptance of all operations carried out on the website.
10. Liability
All items sold on the website comply with Portuguese legislation and are described and presented as accurately as possible.
Without prejudice to responsibilities regarding the protection of personal data, Martha Almeida Jewellery has only an obligation of means for all stages from access to the website, through the ordering process, to delivery and subsequent services. Martha Almeida Jewellery excludes all warranties and any liability for inconveniences or damages arising from the use of the Internet network and the operating system, in particular interference or service interruptions, external intrusion, computer viruses, breakdowns, disconnections or any case of force majeure that may temporarily prevent access, browsing or the provision of services to the User.
Martha Almeida Jewellery reserves the right to modify, at any time and without prior notice, the information and commercial offer presented on the website regarding items, orders, prices, promotions, commercial conditions and services.
All efforts are constantly made to ensure that the information shown on the website is free from typographical errors or omissions. However, if the information shown does not correspond to the characteristics or price of the item, the User will be contacted and given the correct information, and will have the right to cancel their purchase with a due refund for the item (shipping costs included). Whenever an anomalous situation is identified, it is corrected immediately.

If any of the clauses of these conditions becomes null and void as a result of a change in legislation or regulations, or by court ruling, this shall not in any case affect the validity and observance of the remaining clauses.
